Inside Kandi Burruss and Todd Tucker’s Explosive Divorce: Custody War, Prenup Drama, and New Court Filings
Kandi Burruss and Todd Tucker’s split is getting increasingly messy as their divorce continues to unfold in court — and the latest filings reveal a full-blown fight over custody, the prenup, and what information the public will be allowed to see.

According to court documents, Todd Tucker filed his response to Kandi’s divorce petition on Wednesday, November 26. In the filing, Todd claimed their two children — Ace, born in 2016, and Blaze, born in 2019 — “are currently in his care and residing with him in Georgia,” while Kandi handles “out-of-state work obligations.”
Todd, 52, argued those obligations “will continue to require her to be away from the children for at least the next several months,” as he asked the court for primary physical custody, joint legal custody, and final decision-making authority. His filing emphasized the pair’s ongoing cooperation, noting, “The parties have been working cooperatively in an effort to resolve all issues, and [Tucker] remains committed to continuing those discussions in good faith.”
Todd Tucker’s lawyer praised Kandi as a mother, with the filing stating he “recognizes [Burruss] as a loving and capable parent” and hopes continued talks “will bring full resolution of all matters.” Still, he proposed “[Burruss] having substantial time and meaningful access to the children.”
Todd also challenged the couple’s 2014 prenuptial agreement, admitting he signed it but alleging he was pressured into doing so without counsel present. His filing claims the agreement “was presented to [Tucker], without [Tucker] having counsel… immediately before the wedding ceremony,” calling the circumstances questionable. He also demanded a “division of all marital assets” and alimony if the prenup is ruled unenforceable.
Days later, Kandi Burruss fired back.
The Real Housewives of Atlanta alum filed multiple motions to keep their divorce proceedings sealed, arguing she and Todd are “public figures working in the entertainment, television and film industries.” Her filing asserts it is in the children’s best interest that all financial and custody-related information be kept confidential. Her attorney wrote that sealing the case would “prevent disclosures on social media, internet, and media at large… compromising the integrity of the overall proceedings.”
Todd Tucker has not yet responded to the request.
Kandi also submitted an amended petition on December 1 addressing Todd’s claims about the prenup. She said he was represented by a high-powered attorney at the time and pointed to Bravo footage of their wedding special as evidence. Her lawyer wrote, “The parties’ journey to executing an enforceable Prenuptial Agreement was filmed and broadcast… with the knowledge and consent of both [Burruss] and [Tucker].” The filing notes that Todd “audibly announced” he was “good to sign” the agreement after speaking with his attorney “on and off camera.”
Meanwhile, Todd maintained in court that although he received the agreement before the wedding, his lawyer “was not present when he was given the final draft.” In her filing, Kandi asked for joint custody and requested the prenup be upheld. She acknowledged the couple accumulated marital debt, stating it “should be subject to equitable division directed by the Prenuptial Agreement.” Kandi Burruss also asked the court to determine child support and declared the marriage “irretrievably broken” with “no reasonable hope for reconciliation.”
The divorce filings continue to unfold as both sides gear up for what looks to be one of RHOA’s most dramatic splits yet.
